Ethics and Technology: The Rules Have Changed!
Speakers: Al Carr and Sharon Nelson
As recently as this summer, the ABA Model Rules of Professional Conduct have changed again in an attempt to address the ways in which technology has demanded a reexamination of our ethical obligations. Thinking about moving your data to the cloud? Do you outsource? Do you know what is now included in the definition of “competence” in Rule 1.1. Are you aware of how the rules have changed with respect to marketing in the electronic era? Ethical marketing can be very effective, but you need to keep ethics in mind as you use new technologies!

Sensei’s President, Sharon D. Nelson, has been appointed to the ABA’s Cybersecurity Privacy Task Force. The Task Force will address the increasing array of issues at the intersection of cyberspace security and privacy in the business law context. The group, which is part of the Electronic Privacy Subcommittee of the Cyberspace Law Committee, will focus initially on helping business lawyers in e-commerce areas understand and deal with the sweeping changes underway as a result of legislative and government responses to the September 11th terrorist attacks.
In the October edition of Digital Detectives, co-hosts Sharon D. Nelson, Esq., President of Sensei Enterprises, Inc. and John W. Simek, Vice President of Sensei Enterprises, join returning guest attorney Craig Ball, to talk about Special Masters in e-discovery.
