Digital Detectives: Interview With Retired Magistrate Judge John Facciola

There is probably no one in the e-discovery world who has not heard of retired Magistrate Judge John Facciola – and most of us have been lucky enough to attend some of the many CLEs he has taught. In our recent Digital Detectives podcast, Judge Facciola talks about the limited number of lawyers who really "get" e-discovery (perhaps 500-1000), how he believes we should educate lawyers and law students, the impact of the high costs of e-discovery (including driving the middle class out of the courts), the need for law firms to invest in e-discovery training, the need for transparency and cooperation in the e-discovery process, and how aggressive judicial management in e-discovery has been welcomed by trial lawyers.

The Judge was a fun guest and we especially enjoyed his rejection of being called an "e-discovery rock star" in favor of being called a "Sicilian Stallion." Thanks to Judge Facciola for being our guest and for leavening his valuable thoughts on e-discovery with a generous dollop of humor.
