Can You Go to Jail for E-discovery Misconduct? Yes

September 14, 2010

That's the word from Judge Paul Grimm in Victor Stanley II. The opinion, which runs over 100 pages, includes a 12-page chart (marvelous resource) summarizing spoliation sanctions by Circuits.

Hat tip to buddy Craig Ball for passing this along.

If you don't want to read the whole opinion, be sure you read Ralph Losey's excellent and comprehensive summary of what Ralph calls "a sanctions thriller." His summary contains a link to the actual opinion, which is extraordinarily colorful reading. Judge Grimm wields a scathing golden pen.

If time is short, at least read Craig's shorter summary which also contains a link to the opinion.

There are always a handful of "must-read" cases each year – and this sure is one of them.
