Nebraska Becomes 28th State to Adopt the Duty of Technical Competence

The Nebraska Supreme Court adopted the duty of technical competence in an amendment to its rules on June 28, 2017. The Court amended comment 6 to Nebraska Rule of Professional Conduct § 3-501.1 – the corollary to the ABA's Model Rule 1.1 on competence, as follows:

To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject.
