Texas Becomes 36th State to Adopt the Duty of Technology Competence

With the customary hat tip to Bob Ambrogi, he had a post yesterday about Texas becoming the latest state to adopt the ethical duty of technology competence. The Supreme Court of Texas entered an order on February 26 amending the Texas Disciplinary Rules of Professional Conduct. Like most other states, Texas now states that "each lawyer should strive to become and remain proficient and competent in the practice of law, including the benefits and risks associated with relevant technology (new language italicized).

I had to chuckle a bit because of all the presentations I saw last week at ABA TECHSHOW making reference to the 35 states which had adopted the rule of technology competence. Looks like all of us are going to have to update our slides!
