Essentially, each “Doe” was charged with one count of copyright infringement based on, among other things, a spot check of the purported location of the IP addresses of the alleged infringers. John Simek stated in his declaration that it is impossible to be able to ascertain the identity of the actual of the actual infringer with only the public IP address or prove that the John Does willfully and intentionally downloaded/shared the movie in question.
